Mackenzie is an associate in our specialist litigation and arbitration practice. She supports senior members of the firm working closely with the partners and external barristers on a range of corporate and commercial litigation matters. She has a first class honours degree in law, and an arts degree majoring in Political Science and minoring in Design for Social Innovation from Victoria University of Wellington. Mackenzie has been at Lindsay & Francis since the beginning of 2021 and utilises her attention to detail and organisational skills to assist managing matters for our clients.

    • Waste management project: Representing a leading national waste management company in proceedings alleging a joint venture and fiduciary duties in relation to the development and operation of a long-term organic waste processing facility.

    • Fair trading and consumer protection: Successfully defending Bunnings in a significant and high profile Commerce Commission criminal prosecution under the Fair Trading Act 1986, alleging false and misleading conduct in relation to Bunnings’ “lowest prices” advertising.

    • Director duties litigation: Representing a building and construction company, its various subsidiary companies (some of which have been placed into liquidation), and a defendant director in High Court proceedings resulting from an arbitration award, including appearing in the High Court for interlocutory matters.

    • Building product defects litigation: Successfully negotiating an exit strategy for a leading building supplies company in proceedings arising from residential building defects.

    • Royal Commission of Inquiry into Abuse in Care: Managing disclosure for an institution called to provide documentation for the Royal Commission of Inquiry into Abuse in Care and advising as to best steps to take with relevant media interest. Ongoing management of an individual’s claim to the Teaching Council arising from the Inquiry.

    • Judicial review: Acting for an incorporated society in judicial review proceedings against Auckland Council in relation to non-notification of a resource consent.

    • Foreign relation property dispute: Working with external counsel to provide advice on the application of relevant New Zealand law to a Hong Kong based law firm managing a significant relationship property dispute.

    • CBL Corporation Shareholder Class Actions: Assisting in the representation of four former directors of CBL Corp in two parallel shareholder class actions proceedings, funded by separate third party litigation funders, arising out of the $747m collapse of Dual NZX and ASX-listed re-insurance company, CBL Corporation.

    • CBL FMA Proceedings: Assisting in the representation of four former directors of CBL Corp in proceedings brought by the Financial Markets Authority alleging breaches of continuous disclosure obligations and fair dealing requirements under the Financial Markets Conduct Act.

    • CBL Insurance Director Duties Proceedings: Assisting in the representation of four former directors of CBL Corp in proceedings brought by the liquidators of CBL Insurance alleging breaches of director duties.

    • Commercial leases: Assisting a leading commercial landlord in various matters to enforce leases over commercial premises and related enforcement proceedings.

    • Insolvency creditor claim: Managing a creditor claim in regard to significant assets in the estate of a deceased individual.

    • Relationship property: Working directly with external counsel to manage proceedings regarding competing claims to a will and alleged undue influence as to a family member as an executor, resulting in an eventual settlement.

    • Statutory demand: Appearing in the High Court in relation to statutory demand proceedings arising from alleged failed payments in a contract entered into for the supply of COVID-19 rapid antigen self-testing kits.
